「押してダメなら引いてみな」

　私が家庭裁判所の調停委員として関与した事件の話である。

　Ａ子は、一流バーのホステスとして売れっ子で、客にモテモテでいつも帰宅が遅くなるのを嫉妬した夫が、度々店に来ては嫌がらせをしたり、Ａ子に暴力をふるったりするので、たまりかねてＡ子は家を出て離婚を決意したが、夫が応じないので調停の申立をした。

それが４月のこと。

夫は絶対別れないと頑張り、何回か調停がくり返されて双方の言い分を聞く内、夏も秋も過ぎて初冬にさしかかったある日の調停のこと。

　雪がちらほらする中をコートも無しで出て来た夫は、これ以上頑張ってもＡ子の気持を変えることはできないとわかって、離婚に応じるつもりでいた。

二人の間には子どもも居らず、財産的な問題も無かったので、次回に離婚届を用意して協議離婚を成立させようということになった（同じ離婚でも戸籍記載の体裁上、調停離婚ではなしに協議離婚の形をとりたいと思う人が結構多い）。

　帰りがけにＡ子は夫に声をかけた。

　Ａ子「あんた、寒そうな格好して。コート着ないの？」

　夫　「お前が出て行った後、どこに何があるのかさっぱりわからなくて不便してるんだ」

　Ａ子「んじゃ、これから私、あんたの家に行って冬物出してあげるから」

　さて、最後の調停の日、Ａ子は夫のもとに戻ることにして離婚の調停を取り下げた。
夫の気持の中には明確には「押してダメなら引いてみな」というかけひきは無かったとは思うが、私はこの事件とこの格言をいつもセットで思い出すのである。

　昨日も１つ離婚の調停が成立した。

　これは、私は妻の方の代理人であったが、妻の言い分は、夫の煮えきらない態度、いつも姑の味方ばかりで妻の言い分を何一つ聞いてくれないこと、ケチでこうるさくて子ども達にもいつも経済的にがまんをさせることが多くて、父親として失格なこと、従って慰藉料と財産分与と合わせて少なくとも２０００万円は請求して離婚したいというものであった。

夫の性格からして調停は難航することが予想されたが、何と夫は、２回目の調停で妻の要求に応じ、妻の方が細かいこと、例えば家具は何が欲しい、車の名義をかえてくれ、子どもの生命保険の受取人を自分にしてほしい等という要望を出したのに対し、実におうような態度で、「あっ、いいよ」とうなづくのである。

　帰りがけに、妻がぽつんと言った。

　「早まったかな」

　人間の気持は実に微妙なものである。
